ممانعت از مشارکت در بازبینی اساسنامه

کیهان رضوی به فاصله چند هفته توضیحات خود در مخالفت با حضور من در کمیته بازبینی اساسنامه را تغییر میدهد:

در گردهمایی هییت مدیره
در این گردهمایی که در تاریخ 12 دسامبر توسط هییت مدیره برگزار گردید اعلام میکند:

- گفتگو هایی صورت گرفت،  ولی اعلام نمیکند که این گفتگو ها با چه کسانی بوده است. میتوان این برداشت را داشت که این گفتگو با افرادی غیر از اعضای هییت مدیره صورت گرفته است چون در هیچیک از صورتجلسات نیامده است. این مورد فرضیه ای که عده ای خارج از کنگره برای این نهاد تصمیم میگیرند و هییت مدیره مجری تصمیمات آنها میباشد را تقویت میکند.

- از دلایل ممانعت میگوید که به نظر ایشان خیلی واضح میباشند ولی حاضر نیست این دلایل را بصورت علنی مطرح کند.

در مصاحبه با آی سی ژورنال

در مصاحبه با آی سی ژورنال که چند هفته بعد در تاریخ 25 ژانویه صورت میگیرد وقایع را به گونه ای دیگر توضیح میدهد:

- ایشان منکر این نمیشود که من تقاضا مشارکت در بازبینی اساسنامه را کرده بودم. ولی اعلام میدارد که از من خواسته بود که اعلام کنم که قصدم از مشارکت در بازبینی اساسنامه چه بوده است. آیا کیهان رضوی با تمام داوطلبین به اینگونه عمل کرده است؟ اگر جواب نه است، دلیلش چه بوده است؟

- ایشان اظهار میدارد که من به تقاضا ایشان پاسخ نداده و به میل خود در بازبینی اساسنامه حضور نیافته ام، که صحت ندارد.

کیهان رضوی با خلاف واقع جلوه نمودن آنچه صورت گرفت، میپذیرد که تخلف، تعرض و تبعیضی به حقوق من صورت گرفته است. ولی متاسفانه به جای اینکه راه صحیح رفع مشکل را برگزیند بر خطا های خویش میافزاید. اگر ایشان صادقانه به شرح وقایع میپرداخت، به سئوالات جواب میداد و طلب پوزش میکرد، نه تنها به خود، بلکه به این نهاد و کامیونیتی خدمتی میکرد که به نظر من با ارزش تر از همه فعالیت های سال گذشته اش میبود.

رابطه آی سی ژورنال و هییت مدیره
- همکاری نزدیک میان هییت مدیره فعلی و آی سی ژورنال وجود دارد.
- این رسانه توسط بیژن احمدی، از روسای سابق کنگره و یکی از متهمین پرونده شکایت اعضاء علیه هییت مدیره 2018 مدیریت میشود.
- مصاحبه کننده، مازیار شیبانیفر از همکاران آی سی ژورنال، از آدمین های سابق فوروم کنگره و داوطلبین بازبینی اساسنامه است.
- مهدی صمدیان، یکی دیگر از همکاران این رسانه همزمان در مدیریت فوروم کنگره همکاری دارد.
- محسن خانیکی، خزانه دار هییت مدیره فعلی، یکی دیگر از متهمین پرونده شکایت اعضاء علیه هییت مدیره 2018، از بانیان آی سی ژورنال است.
- آی سی ژورنال در جولای 2019 از من در مراجع قضایی شکایت نموده است و این پرونده هنوز در جریان است.

عدم مشروعیت تغییرات اساسنامه 2020

ورای تعرضاتی که به حقوق من شده، این خلافکاری ها مشروعیت تغییرات اساسنامه را زیر سئوال میبرد:
- فعالیت به مدت یکسال پشت درب های بسته و در جمعی که فقط همفکران حق حضور داشتند
- سانسور، حذف و خلاف واقع نشان دادن وقایع در زمان حساس اطلاع رسانی قبل از مجمع عمومی، با در نظر داشتن این نکته که از 457 عضو کنگره فقط 178 نفر به آن رای داده اند. چه بسا با اطلاع رسانی آنچه که گذشت این نتایج تغییر میکرد.

رفع مشکل بصورت مسالمت آمیز

این مطلب را برای اعضای هییت مدیره غیر از دانیل باقری سروستانی که ایمیل ایشان را در اختیار ندارم ارسال داشته ام. یکبار دیگر نیز آمادگی خود را برای رفع موارد تعرضی و تبعیضی نسبت به خود از طریق مسالمت آمیز اعلام میدارم.  در این راستا دو طرح پیشنهادی خود را اعلام کرده ام:

۱- در پایان یکی از جلسات هییت مدیره، زمانی برای رسیدگی به اعتراضات من اختصاص داده شود. لازم میبینم که این گفتگو ها   بصورت عمومی برگزار گردند.

۲- با توافق یکدیگر هییتی را برگزینیم که کدخدا منشانه به رفع مشکلات بپردازد.

PREVENTING MEHDI SHAMS FROM PARTICIPATING IN THE BYLAW REVISION

Kayhan Razavi, the head of the bylaw committee (Organizational Structure) changed his explanation in opposition to my participation.

IN ICC BYLAW MEETING

At this meeting, which was held on December 12, by the Board of Directors, he announced:

- There were discussions, but he did not announce with whom they were. One can assume that these discussions took place with people other than the members of the board of directors as they weren't mentioned in any of the minutes. This reinforces the hypothesis that some people outside of the ICC make decisions and that the board implements their decisions.

- He talked about the reasons for the prevention that were very clear for him, but he was not willing to present them publicly.

IN THE INTERVIEW WITH IC JOURNAL

In the interview with the IC Journal, which took place a few weeks later on January 25, he described the events differently:

- He approved that I had requested to participate in the bylaw revision. He said also that he asked me to present what I wanted to do in regard to the bylaw. Had Kayhan Razavi acted the same way with all other volunteers? If not, what was the reason?

- He said that I had not responded to his request and did not voluntarily want to participate, which is not true. Kayhan Razavi, by presenting an untrue version of what happened, admits that what he did was wrong and my rights have been violated, and there was discrimination against me. But unfortunately, instead of choosing the right way to solve the problem, he adds to his mistakes. If he had honestly described the events, answered the questions and apologized, he would have served not only himself but also the ICC and our community, which I think was more valuable than all his activities last year.

THE RELATIONSHIP BETWEEN IC JOURNAL AND THE BOARD

- There is close cooperation between the current board of directors and IC Journal.

- This media is managed by Bijan Ahmadi, one of the former presidents of the ICC and one of the defendants in the members' complaint against the 2018 board of directors.

- The interviewer is Maziar Sheibanifar, a fellow of IC Journal, a former admin of the Forum and a volunteer in the bylaw committee.

- Mehdi Samadian, another colleague of IC Journal, is also an admin of the Forum.

- Mohsen Khaniki, the current treasurer of the ICC, is another defendant in the case of the members' complaint against the board of directors in 2018, and one of the founders of IC Journal.

- IC Journal took legal action against me in July 2019 and this case is still ongoing.

LACK OF LEGITIMACY OF RECENT AMENDMENTS TO THE BYLAW

Beyond the discrimination and violations of my rights, these illegal actions call into question the legitimacy of the bylaw revision:

- Acting for a year behind closed doors and in a group where only like-minded people were present.

- Censorship, deletion and misrepresentation of events during the critical information period regarding the bylaw just before the General Assembly, given that only 178 out of 457 members of the ICC voted for the changes. The result may have changed if more people knew the right version of acts.

SOLVING THE PROBLEM PEACEFULLY

I have sent this article to the members of the board of directors, except for Daniel Bagheri Sarvestani, as I don't have his e-mail.

Once again, I declare that I am willing to resolve this case peacefully. In this regard, I propose:

1. At the end of one of your board meetings, please take time to address my objections. I find it necessary for these talks to be public.

2. By mutual agreement, a committee is elected to arbitrate between us.
